Boating while intoxicated??

Not really pertinent to the thread, but close enough...

I was out walking the dog in the woods near my house. On the way back, I saw one of the local police sergeants that I know, so stopped to say hello. Told me that he just saw my brother the other day. My brother is the prosecutor the next town over. My brother was prosecuting a woman who the sergeant and other officers chased though my town and my brother's town while she was driving drunk.

It was her third offense, which is pretty serious in NJ as you can see from Vince's post, so she hired a lawyer. Unfortunately, she hired the most incompetent lawyer in the state. This guy just loved to hear himself talk and asked the most inane questions. I was told that this one case took five hours to adjudicate! It got to the point where the judge was rolling his eyes at this woman's attorney. At that point, the officers and my brother looked at each other and knew they won. She got jail, loss of license, etc. Basically the maximum penalties that the judge could throw at her.

Here were are talking about drinking while operating a dinghy? I'm sure they have that one covered. In a lot of states, it isn't even safe anymore to use your horse as a designated driver. If you can't use trusty Mr. Ed to get you home, then the states are going too far.

It looks like you can sail a 11'6" sailboat (no power and under 12') while you're near ready to pass out....

The average man 180lbs can drink 1 beer per hour, I'm guessing a horse in the neighborhood of 11 or so beers/hour? Does ETOH even cross the blood brain barrier of a horse?

Not to make this more confusing than it already may be . . .

I just finished taking a 9 week safe boating course (for insurance and refresher purposes) and here is what I learned on this subject. "Any vessel underway is a vessel under control . . . whether powered mechanically or by natural forces". This means that a sailboat, kayak or motorboat when underway is a vessel that can be the "stand-on" or "give-way" vessel and the Captain of that vessel is responsible for the actions of that vessel. Long story short, in Minnesota you can get a BWI in any of those circumstances if you blow .08 or higher. And, yes, your auto driving privileges are affected too.

More studies show that most boaters are untrained and not paying attention anyway...which is the bigger danger?

When idiots can lose THEIR licenses for being naturally stupid, perhaps punishing boaters for a marginal BAC will also make sense.
 
I worked with a guy that lost his drivers license for riding his bicycle while drunk. It was called OUI Operating under the influence. I believe he drove into a car at an intersection. It was in Mass.
 
Massachusetts treats BWI the same as DWI. Your operator's license can be suspended for either.

Save the consuming of alcoholic beverages, or should I say "heavy drinking", for after the vessel is secured for the day. Wind, current, alcohol, and tight places do not mix. It's a recipe for damage.

Other studies have shown that most studies are done by lackies with nothing else to do, and with preconcieved notions that they attempt to "prove" with the "study". Studies by MADD show that driving past a bar or liquor store causes impairment.

The problem that I have with this is that the level of impairment for a given quantity of alcohol or BAC varies from peson to person. i am not a "big" drinker. After 3 beers in a 2 hour period, I wouldn't even think about operating a vehicle. I have friends that can drink 6 beers in that same time frame, and be fine operating a vehicle. BAC alone is not a good measurement.

Bottom line is that I can't even go to dinner with my fiance and have 2 glasses of wine without being considered "impaired". That is just plain ridiculous.

It has become just another source of revenue for the government, and another excuse to screw with just about anybody at any time. Yeah, there should be limits. But they should be based on one's actual ability at the time, not a generic BAC number that doesn't mean the same level of impairment to everybody.
