Meanwhile... back on the chicken farm... the economy has tanked. Surely this will not hold up in court... talk about a violation of the constitution.

Wes can just call the cops when things get out of control now....

First amendment rights don't mean anything to well meaning laws passed by the left. Remember the so-called election reform bill? It's illegal for groups, organizations, or individuals to purchase ads in support of their candidate. Seems a clear enough first amendment violation, but the left leaning courts, including the supreme court said it was OK because it's for a greater good or some crap like that.

So, in the end... stock up on vaseline.

this is the stupidest thing since the fat tax on soft drinks with sugar that was proposed this year. How bout' we push through some legislation where we can throw Dem's from California in Jail.
 
While I agree with your assessment of this particular proposed legislation....how do you address the problem of a mentally challenged or angry person going off on somebody by making terrible things up about them and posting them on the internet?

Slander statutes typically require proof of economic harm. For teenagers and kids that is an impossible bar to clear.

You are trying to apply logic, to which our gov't fails to do. This proposed law does not achieve that bar.

The real problem, the politicians take that rare high profile case and use it as a platform to look like they are trying to do good. These yahoos don't focus on root causes they only focus on the manifestations at the expense of the constitution.

Unlike a face to face confrontation, the internet or social web thingy's are 100% voluntary. If some wako comes up to me on the street and wants to start something, I have to deal with it as it's an immediate and possibly unavoidable threat. If someone posts something mean about me on the internet, I just don't log into that site. Heck, if I didn't log in here everyday, I wouldn't know I was called an idiot at all.
 
So what will be next...are they going to then go after radio/tv talk shows and what is said there by the host and callers? They don't have enough room in jails now for the really bad people, like murders, drug dealers, and robbers.
 
Well, you guys have to decide, as I have read posts about today's parents being so bad. So...nanny government has to protect these poor children.

Are we for real? I could care less if anybody here calls me a name. I'm surly not gonna go get the magnum and put it to my head. Where were Mom and Dad? Nobody watches what there kids see on the computer. I'm divorced and can't moniter my son's surfing habits so I regularly tell him about "Real Life" and that loosers stay there whole life around the myspace, twitter crowd.
Sorry to say but this is just another case of the Darwin Award....Now take me to Jail!
 
Public figures are not protected by libel or slander laws. Private citizens are protected to a degree. In order for a private citizen to receive restitution, actual damage must be proven. This case is a gray area in my opinion.

The California Legislature should stay out of this. Exiting laws are already adequate.

Last week when I was in Jacksonville, a friend and I was walking to the parking lot when a begger came up to him and asked for money.

Whether it's this proposal here, or TARP, or single-payer (govco) health care, or the Chrysler/UAW "taking"...all politicians look for only one thing: Political Benefit. Everything they do is for a calculated political benefit. So...the more they do, you can be sure they have figured the benefit for them. In essence, they are trying to keep their power in perpetuity.

Just my humble opinion.

This is the perfect example of the mindset which thinks big government will solve all of our problems.

Jitts - I don't think you are off-base at all. I can't monitor my kids all of the time but I've let them know I can and do check the history on their browsers. I've also set the ratings control which sucks really - since non-rated pages can be things as simple as disney.com. But - they know my wife and I will check and they only go to the sites which they are allowed to go to. The latest thing is clubpenguin.com which they can chat, interact, etc with other kids (hopefully kids) online. As a parent I can log into an admin account and see what they are doing, how often they log in, etc.

Bottom line - parents have to take responsibility for their actions and their kids. The problem is most people do not want to be held accountable for their actions and want to always blame someone else. As US consumers, we don't even get the same products or same features as other countries since the manufacturers are afraid of lawsuits. It's out of control and this sort of attention grabbing BS by lawmakers certainly wont help us out any.
