Since boats built before 2020 don't need it, I can see a lot of people who don't want to use it removing or disabling the switch. If an older boat has it, but it doesn't work, it is not required that they fix it.
 
Interesting the way these regulations are written.
If you have an older boat without a cutoff, you do not need to install one.
If you have an older boat with a cutoff, you must use it.
Similar to the radar system regulation which requires us to have it on when underway, only if the boat is equipped with radar.

I have to go check my old ‘89 now to see if it even has one!!

@Stee6043, come to Charlevoix sometime. The Coast Guard is all over Lake Charlevoix doing safety inspections all summer long - and tons of boats under 26’. I imagine the same for other ports along the Great Lakes that have lakes and tributaries to the open water. I wouldn’t isolate this to the poor guy in the Regal 250 on Lake Michigan.
As stated above not for older boats but if they tried that I would change my stickers from 250 to 270.

It’s actually pretty clear, regardless of year of boat or motor. If it has a kill switch that works, you must use it. If it’s a 2021 it should have a kill switch that works or you need warranty work.

On a side note, my buddy almost lost his life in traverse city when he was in his dinghy with a 15hp on plane. Looked over his shoulder behind him and the dinghy jerked, threw him over board. His wife and I were watching from the beach as the dinghy kept circling him nearly running him over about 10 times until another boat ran into it on purpose to flip it. I’ll never forget (15 years ago) and always wear my lanyard in the dinghy.
 
@MonacoMike I reread the FAQs after that post on the other forum came up and @tc410 is correct. Buried in the FAQs, if it's equipped with it, you must use it. Now if it breaks or is no longer functional, you're only required to repair/replace it on a 1/1/2020 or newer.
