BoatUS magazine May 2007 reported a class action suit involving the C-12s and 3196s. It went on to say "BoatUS records include reports of aftercooler and related failures from owners of 1996 and newer Caterpillar 3116, 3126, and 3208 engines."
Models other than the C-12 and 3196 that used specific aftercoolers will be automaticly included in the class action.

Thanks for the heads up. I checked the part number for the aftercooler on my 3126's and mine aren't one of the "models other than C-12 or 3196."
 
What happens? ......The lawyers make an immoral amount of money and the class members usuually get to "feel good" about it.

Owners must be admitted to the class based on ownership dates. A claims form usually must be completed where you cite the date you bought and the date you sold your engines as well as the cost you incurred to get them fixed.

You do not own 3196/c-12's so you are and cannot be a class member and will not share in any award, if there is one. Perhaps, if the present owner of the boat you are buying filled out the claim forms, had the right dates or ownership and was admitted to the class action, you can get him to assign any award he gets to you as a subsequent owner.
 
And if you do all that, you'll get a check in the mail for $63.45. Meanwhile, back at the chicken ranch, all the law firm's partners will take home their $2,000,000 bonus (each) for the suit.

Actually, The real outcome of the class action suit is going to be interesting. Caterpillar was really good about keeping owners whole on engine failures. They rerplaced/rebuilt a ton of engines for owners. One of the claims in the suit is for loss of use and most manufacturers warranties clearly exclude loss of use as a warranty item.
 
One of the real problems with the 3196s and C-12s is the effect it had on Sea Ray. Clearly, a big reason for dropping Caterpillar engines in favor of Cummins and MAN was the Caterpillar failures. Sea Ray as a boat builder and assembler ended up in the middle, generally not a good position to be in.

Caterpillar tried to stand behind their product but to put it bluntly the screw up was to big even for Caterpillar. My first 3196 went after 24 hours on the clock.
